APPROVED MINUTES SPECIAL TOWN BOARD MEETING JULY 22, 2022 – TOWN HALL AGENDA WAS POSTED AUGUST 3, 2022 AT THE TOWN HALL, TRANUS LAKE RD AND ON THE WEBSITE BY KATIE PARKS, CLERK. PRESENT: GARY ELLIOTT, CHAIRMAN; SANDY JOHNSON, TREASURER; DAYNA DULLINGER, SUPERVISOR; DONALD PLANTE, SUPERVISOR; KATIE PARKS, CLERK; BILL & NAOMI COCHRAN, TERRY KANNEGIESSER, JIM ZOPP, LUKE & DESARAE SEVERSON, ED WOLLWERT, LINDA PLANTE, LEE JOHNSON. 1. VERIFICATION OF LEGAL POSTING DONE BY THE CLERK ROLL CALL: ELLIOTT, JOHNSON, PARKS, DULLINGER, PLANTE CHAIRMAN CALLED MEETING TO ORDER AT 7:00 PM PLEDGE OF ALLEGIANCE RECITED 2. APPROVAL OF AGENDA - MOTION BY DAYNA DULLINGER TO APPROVE, 2ND DONALD PLANTE, MOTION CARRIED. 3. PUBLIC INPUT 4. SPECIFIC MATTERS FOR DISCUSSION AND ACTION BY THE TOWN BOARD: A. SEVERAL OF THE ABOVE RESIDENTS AT THE MEETING REPEATED THEIR CONCERNS FROM THE JULY 12TH MEETING, ALSO ADDING CONCERNS REGARDING AMBULANCE COST, THE AMOUNT OF WATER REQUIRED TO FILL THE POND, AND WATER ACCESS TO THE NAMEKAGON RIVER, AND ACCESS TO THE CAMPGROUND FROM HWY 63 AND THE NEED FOR EXTRA LAW ENFORCEMENT. THERE WAS ALSO TWO LETTERS SUBMITTED BY MICHAEL & JILLIAN JALOWITZ AND JERRY YOUNG, WHO COULD NOT ATTEND THE MEETING IN PERSON, EXPRESSING THEIR CONCERNS. THE BOARD SHARED THOSE LETTERS WITH THOSE PRESENT. AT ONE POINT A CONSTABLE WAS MENTIONED, BUT IT WAS EXPLAINED BY THE CHAIRMAN THAT THE COST WOULD BE TOO MUCH FOR THE TOWN TO ABSORB WITHOUT THE NEED TO RAISE TAXES FOR THE RESIDENTS. WE WOULD BE PUTTING THE CART BEFORE THE HORSE TO ASSUME THE WORST CASE SCENARIOS WOULD SURELY HAPPEN THAT WOULD REQUIRE US TO HIRE A CONSTABLE PREMATURELY. HE ALSO STATED THAT THE CAMPGROUND OWNERS WOULD HAVE TO ABIDE BY THE REQUIREMENTS AND CONDITIONS SPECIFIED IN ANY COUNTY ORDINANCE OR BY THE COUNTY ZONING BOARD AS SET FORTH IN THE 2017 ASSEMBLY BILL WISCONSIN ACT 67. THE TOWN’S DECISION TO APPROVE OR DENY THE PERMIT MUST BE SUPPORTED BY SUBSTANTIAL EVIDENCE, MEANING FACTS AND INFORMATION, NOT JUST PERSONAL PREFERENCES, HEARSAY OR MERE SPECULATION. MUCH RESEARCH WAS DONE IN ORDER TO MAKE AN UNBIASED DECISION. TALKING TO THE LEGAL STAFF AT WTA, OTHER TOWNS THAT HAVE FACED SIMILAR SITUATIONS, AND WASHBURN COUNTY OFFICIALS WHO ARE FAMILIAR WITH THE CONDITIONAL USE PERMITS PROCEDURES AND WHAT IS REQUIRED BY A TOWN BOARD IN REGARD TO MAKING A DECISION TO APPROVE OR NOT. THE FINAL VERDICT WAS THAT, “IF THEY MEET ALL REQUIREMENTS FOR THE CONDITIONAL USE PERMIT, WE ARE DUTY BOUND TO APPROVE THE PERMIT. IN ORDER TO DENY THE PERMIT WE MUST HAVE OVERWHELMING PROOF OF ILLEGALITIES, DOES NOT MEET STATE DOT OR DNR REQUIREMENTS, AND IS A DANGER TO OTHER RESIDENTS OR THEIR PROPERTY. IF A RESIDENT WANTS TO CHALLENGE A CONDITIONAL USE PERMIT, THEY MUST PRESENT REASONS WITH PROOF NOT HEARSAY INFORMATION TO BACK UP THEIR COMPLAINT.” HAVING EXPLAINED THIS TO THE RESIDENTS IN ATTENDANCE THE TOWN CHAIRMAN, GARY ELLIOTT MADE A MOTION TO APPROVE THE CONDITIONAL USE PERMIT WITH THE STIPULATION THAT THEY ADHERE TO THE SAME 13 RULES AS OUTLINED BY THE WASHBURN COUNTY ZONING DIVISION IN THE PERMIT GRANTED TO LEE MAGNUSON/CAMP NAMEKAGON CAMPGROUND ON JUNE 28, 2022. DONALD PLANTE, 2ND TO APPROVE. DAYNA DULLINGER OPPOSED. MAJORITY MOTION CARRIED. THE SIGNED PERMIT WAS DELIVERED TO THE ZONING DEPARTMENT AT WASHBURN COUNTY BY THE CLERK, KATIE PARKS ON MONDAY, JULY 25TH FOR CONSIDERATION IN THEIR DECISION EITHER TO DENY OR APPROVE THE PERMIT ON JULY 26, 2022. 5.
